Power Usage Data Collection Agreement
This Power Usage Data Collection Agreement ("Agreement") is entered into between Kzoo Makers, hereinafter referred to as the "Makerspace," and its members, hereinafter referred to as the "Members," collectively referred to as the "Parties."
1. Purpose of Data Collection
The Makerspace is collecting power usage data (kWh) for its facility, exclusively for use by its members. The primary purpose of this data collection is to utilize utility energy data to create visualizations for the Tidbyt clock and for the website.
If you enter into agreement of datasharing your Consumers account as a member, then we shall provide a simple API to poll hourly and daily kWH statistics, and Tidbyt app integrations as well.
2. Data Collection and Retention
- The power usage data will be collected and stored with hourly granularity, up to and including the maximum retention period allowed by the partner agreement with Consumers Energy.
3. Data Privacy and Confidentiality
- The power usage data collected will be used solely for internal analytics and visualization purposes by Makerspace members.
- Under no circumstances will the data be shared outside the scope of analytics collection for the purposes of visualization by members. This means third-parties and companies are not authorized to use this data.
- Any data leaving the Makerspace network for the purpose of member consumption will have the service addresses stripped to prevent the disclosure of service addresses.
4. Member Obligations
- Members agree to use the collected power usage data exclusively for scientific and educational purposes.
- Members shall not disclose, share, or distribute the data without explicit authorization.
- Members shall comply with all applicable laws and regulations regarding data privacy and security.
5. Termination
This Agreement shall remain in effect until terminated by either party. In the event of termination, members shall cease using the data and return any copies or derivatives of the data to the Makerspace.
6. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of Michigan, without regard to its conflict of law principles.
